Brennan Brand ("Brennan Brand," "we," "us," or "our") respects your privacy. This Privacy Policy explains what information we collect when you visit brennanbrand.com (the "Site") or work with us, how we use and share it, and the choices and rights you have. By using the Site, you agree to this Policy. If you do not agree, please do not use the Site.

1. Who we are

Brennan Brand is a brand strategy and creative consulting practice founded by Erin Brennan. You can reach us anytime at erin@brennanbrand.com. For privacy questions, that is the best address to use, and we treat it as our privacy contact.

2. Information we collect

  • Information you give us directly. When you fill out our free consult form, contact us, book or pay for a call or session, sign up for our newsletter, or otherwise communicate with us, we collect the information you choose to provide. This typically includes your name, email address, company or website, and any details you share about your business, goals, or project. If you purchase a paid call, session, or service, you also provide billing details — though payment card numbers are handled by our payment processor, not stored by us (see Section 4).

  • Information collected automatically. Like most websites, our Site automatically collects basic technical information when you visit, such as your IP address, browser type, device type, the pages you view, the date and time of your visit, and the website or search that referred you. We collect this through cookies and similar technologies and through our website and analytics providers. See our Cookie Notice below.

  • Information from third parties. We may receive information from the tools we use to run our business — for example, a scheduling tool when you book a call, or our email platform when you open or click a newsletter.

We do not knowingly collect information from anyone under 18. If you believe a child has provided us information, contact us and we will delete it.

3. How we use your information

We use the information we collect to:

  • respond to your inquiries and provide the consultations, calls, sessions, and services you request;

  • process payments and send receipts, invoices, and related communications;

  • send you our newsletter and marketing emails, where you have signed up or are an existing client (you can opt out anytime);

  • operate, maintain, analyze, and improve the Site and our services;

  • understand how visitors find and use the Site, including through analytics and search data;

  • protect against fraud, enforce our terms, and comply with our legal obligations.

We do not sell your personal information, and we do not share it for cross-context behavioral advertising.

4. The service providers and tools we use

We rely on trusted third-party providers to run the Site and our business. They process your information only to provide services to us, under contracts that limit their use of it. These include:

  • Website hosting and forms — Squarespace, which hosts our Site and powers our contact and consult forms;

  • Payments — Stripe, a third-party payment processor that handles online payments for calls, sessions, and services; we never see or store your full card number;

  • Scheduling — Acuity Scheduling, a booking tool used to schedule calls and sessions;

  • Email marketing — Flodesk, the email platform used to send our newsletter and updates;

  • Analytics — Google Analytics, Google Search Console, and Microsoft Bing (Bing Webmaster Tools), which help us understand Site traffic and performance.

Each of these providers maintains its own privacy policy governing how it handles information. We may add, change, or replace these providers from time to time; this page reflects the providers we currently use.

5. Cookie Notice

Our Site uses cookies and similar technologies. Cookies are small files placed on your device that help websites function and help us understand how the Site is used.

We use:

  • Strictly necessary cookies that make the Site work (for example, keeping your shopping cart or session active).

  • Analytics cookies that help us understand how visitors find and use the Site, so we can improve it. These may be set by tools such as Google Analytics.

  • Functional cookies set by tools we embed, such as our scheduling or forms providers.

6. How we use artificial intelligence (AI)

Brennan Brand uses artificial intelligence tools as part of how we work. We use AI to gather and analyze publicly available data, research markets and competitors, surface insights, and help produce strategy and marketing deliverables. In the course of this work, we may process information you provide to us — for example, details about your business, website, or goals — using AI-assisted tools.

When we do this, we apply the following commitments:

  • We use information you provide only for the purpose for which you gave it to us (delivering our services to you), consistent with this Policy.

  • We do not sell your personal information, and we do not provide your personal information to AI providers to train their public models, except where you have specifically agreed.

  • Where we use third-party AI services, we work with providers that contractually limit their use of data to providing the service to us.

  • We do not use AI to make legal, financial, or other decisions that produce significant effects about you without human involvement.

7. How we share information

We share information only as described in this Policy:

  • with the service providers and AI tools described above, to operate our business;

  • if required by law, subpoena, or other legal process, or to protect the rights, property, or safety of Brennan Brand, our clients, or others;

  • in connection with a business transaction such as a merger, acquisition, or sale of assets, in which case we will require the recipient to honor this Policy.

We do not sell or rent your personal information to third parties for their own marketing.

8. How long we keep information

We keep your information for as long as needed to provide our services, maintain our business records, comply with legal and tax obligations, and resolve disputes. When we no longer need it, we delete or de-identify it. You can ask us to delete your information as described below.

9. Your privacy rights

California residents (CCPA/CPRA). If you are a California resident, you have the right to:

  • know what categories of personal information we collect and how we use and share it;

  • request access to the specific pieces of personal information we hold about you;

  • request that we correct inaccurate information;

  • request that we delete your information;

  • opt out of any sale or sharing of personal information (note: we do not sell or share your personal information); and

  • not be discriminated against for exercising these rights.

EU/UK and other regions (GDPR/UK GDPR).

If you are in the European Economic Area, the United Kingdom, or a similar jurisdiction, you have the right to access, correct, delete, restrict, or object to our processing of your personal information, and the right to data portability. Where we rely on consent (for example, marketing emails), you can withdraw it at any time. We process your information on the legal bases of your consent, our legitimate interests in operating and improving our business, the performance of a contract with you, and compliance with our legal obligations. You also have the right to lodge a complaint with your local data protection authority.

How to exercise your rights.

Email erin@brennanbrand.com with your request. We will verify your identity and respond within the time required by applicable law. You may use an authorized agent to submit a request on your behalf.

10. How we protect your information

We use reasonable administrative, technical, and physical safeguards to protect your information, and we work with providers who do the same. No method of transmission or storage is completely secure, so we cannot guarantee absolute security, but we take protecting your information seriously.

11. International visitors

We are based in the United States, and the information we collect is processed in the United States. If you access the Site from outside the U.S., you understand your information will be transferred to and processed in the U.S., where data protection laws may differ from those in your country.

12. Third-party links

The Site may contain links to websites we do not control. We are not responsible for the privacy practices or content of those websites. We encourage you to review their privacy policies.

13. Changes to this Policy

We may update this Policy from time to time. When we do, we will revise the "Effective date" above. Significant changes will be posted on this page. Your continued use of the Site after changes are posted means you accept the updated Policy.
